Covenant Violation Complaint Process

General

  • The St. Andrews Board of Directors and its associated committees will not “police” the neighborhood specifically looking for violations.
  • Neighbors should attempt to resolve covenant issues between themselves.
  • However, if it is felt that personal contact will result in animosity and ill-will between neighbors, a complaint may be lodged with the board.
  • The board will not attribute the complaint.
  • If the Covenants Committee’s/Board’s resolution is not satisfactory to the complainant and/or respondent, then the complainant and/or respondent may request a meeting with the Board for further consideration.

Submitting Complaints to the Board

  • Complaints may be submitted verbally, electronically, or in writing. Although written is the preferred format, in cases where immediate attention seems warranted, complaints may be submitted verbally to any member of the board.
  • The complaint must refer to the covenant that it alleges is being violated, and the address where the alleged violation is occurring.
  • The Board of Directors and/or a working subcommittee will review the allegations and recommend a course of action. Board’s actions may include a written letter, phone call, electronic mail message, an actual meeting in person with the respondent and/or complainant, or a combination of any of the above.
  • If safety or health factors are an issue, the Board may elect to contact the police or fire department, or the “Code Enforcement” division of the city.
  • The Board will set a reasonable date for compliance, if applicable.
  • Finally, if the respondent fails to remedy the situation after a reasonable amount of time that has been afforded by the Board, then the Board may file a legal action to force compliance. If such an event occurs, the respondent will be liable for all reasonable costs and attorney fees as allowed by the St. Andrews governing covenants.

I.A.W. Colorado House Bill 08-1135, the HOA Board revised the complaint process in September 2013.
